Terms of Service

These Terms of Service (“Terms”) govern your use of the Atlas Navigation website at atlas-navigation.com and related services (collectively, the “Service”) operated by Atlas Navigation, Inc. (“Atlas,” “we,” “us”), a Delaware corporation.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Atlas provides predictive TSA security checkpoint wait time estimates for U.S. airports. Our predictions are generated using machine learning models, publicly available data, and voluntary crowdsourced user reports.

Informational Only. All wait time predictions, estimates, and data provided by Atlas are for informational purposes only. They are not guaranteed to be accurate and should not be your sole basis for travel planning decisions. TSA wait times are influenced by many factors outside our control, including staffing changes, security incidents, weather, and passenger volume fluctuations. Always allow extra time for your trip.

2. Accounts

You may browse limited features of Atlas without an account. To access full functionality, you must create an account using Google Sign-In or another supported authentication method.

You agree to provide accurate information when creating your account. You are responsible for all activity under your account. Notify us immediately at team@atlas-navigation.com if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Scrape, crawl, or use automated means to access the Service or extract data
• Reverse-engineer, decompile, or attempt to derive the source code, algorithms, or data models of the Service
• Redistribute, resell, or sublicense Atlas data or predictions without written permission
• Interfere with the operation of the Service, including by circumventing rate limits
• Use the Service for any unlawful purpose
• Create multiple accounts to circumvent usage limits or enforcement actions
• Impersonate another person or misrepresent your affiliation with any entity
• Submit false or deliberately misleading crowdsource reports

Violation of these terms may result in rate-limiting, account suspension, or permanent revocation of access.

4. Crowdsourced Reports

By submitting a crowdsource report, you grant Atlas a non-exclusive, royalty-free, worldwide, perpetual license to use, store, aggregate, and incorporate your report into our prediction models and datasets. Reports are voluntary. You agree that submitted reports are accurate to the best of your knowledge.

Crowdsource data may be aggregated and used in de-identified form to improve predictions, train machine learning models, and generate insights. Individual reports will not be publicly attributed to your account.

5. Intellectual Property

The Service, including its design, code, algorithms, prediction models, aggregated datasets, trademarks, and content, is owned by Atlas Navigation, Inc. and protected by U.S. and international intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

“Atlas,” “Atlas Navigation,” “Know Before You Go,” and associated logos are trademarks of Atlas Navigation, Inc.

6. Paid Subscriptions

If you purchase a paid subscription, the following applies:

Billing. Subscriptions are billed on a recurring basis (monthly or as otherwise specified at the time of purchase) through Stripe. You authorize us to charge your selected payment method.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

Price Changes. We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PREDICTIONS WILL BE ACCURATE. TSA WAIT TIMES ARE INHERENTLY UNPREDICTABLE AND SUBJECT TO RAPID CHANGE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS NAVIGATION, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Atlas Navigation, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Arbitration. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Austin, Texas or remotely at your election.

Class Action Waiver. You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Exception. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

11. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with a new “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance. If you do not agree with the revised Terms, stop using the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 4, 5, 7, 8, 9, and 10 survive termination.

13. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atlas regarding the Service.

Waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Assignment. You may not assign your rights under these Terms. We may assign our rights to any successor entity.
